九七回歸衍生的《特權法》
民主派8人因5月立會衝突而被控告涉嫌違反《立法會(權力及特權)條例》第17及第19條。
訂立《特權法》的歷史背景是1984年中英聯合聲明簽署，香港九七回歸成定局，港英政府着手在香港推動代議政制，1985年立法局突破全委任格局，首次有間接選舉，並通過《特權法》。時任布政司夏鼎基在法案二讀無明言港英政府預見九七後代議政制會遭受行政機構威脅，但不言而喻，夏鼎基說傳統上英國國會議員享有的特權包括辯論發言不被起訴誹謗、會議期間不被逮捕等，可供香港參考，《特權法》目的是使到每位議員無畏無懼地履行職責。
《特權法》第17條規定，「任何人」不服從立法會命令列席聆訊、出示文件、回答問題，或擾亂會議，即屬藐視罪，第19條則禁止「任何人」干預議員、立法會人員或證人。原意是一條保護議員立法權免受外力包括行政機關干預的法例，只要瞭解一下訂立《特權法》的背景，就會明白「任何人」不應包括議員本身。律政司引用該兩項條文控告議員，荒謬而本末倒置。議員若有行為不當，自有議事規則及《基本法》第79條家法處理，行政機構卻濫用公權力插手立法會，打壓民主派不遺餘力。
眼見法律界前輩憑如簧之舌，儼如上庭打官司維護客戶最大利益般，經常為特區政府此等劣行背書，不分青紅皂白，實在可悲。我們首先是人，其次才是資深大律師，共勉之。
