兩人撤控 法治小勝 吳靄儀

在去年8 月24 日觀塘遊行事件被捕及控以「暴動」罪的劉振鑫、張文偉，早前2 月21 日再度提堂時，獲撤銷控罪，兼得堂費，是法治的一次小勝，雖然兩人6 個月來自由受到嚴重限制，個人和家人身心飽受折磨，不公義之處不是獲償還若干訟費可以彌補，但仍是值得重視的勝利，因為事件顯示，律政司仍有法律專業人士能把關，不夠證據就要撤回檢控，而法庭亦讓人看到大公無私，控方提不出令人信服的理由稱被告人「自招嫌疑」，法庭就得判被告人獲堂費。

劉振鑫、張文偉是控方撤回「暴動」控罪的首宗案件，看報道的案情，撤控是理所當然，尤其是觀塘遊行已有不反對通知書，而被告人劉振鑫在警方「驅散行動」下逃走——既然「驅散」，「逃走」是絕對合理，怎能因此而入之以罪？同時，搜獲的種種「自招嫌疑」的物品，全部屬警暴之下，和平示威有合理需要的自我保護物品，如何能招致「暴動」的嫌疑？我期望更多類似的案件會早日得到撤控。為此，律政司應大量增加人手加速審核及發出指示。其實這不單對被告人較公平，同時亦可避免被告人因案件不斷延誤而不斷加重法律費用負擔，最終要政府加大賠償金額。
兩名被告人的控罪撤回， 但餘下被告人吳仲謙仍要面對不知拖延到幾時的審訊，這本身已是對他不公平，加上保釋條件嚴苛，實質上已形成懲罰，違反了「無罪推論」的根本精神。（ 案件編號：KTCC1597,1606/2019）
