新聞自由是公眾利益 梁家傑

傳媒天職是發揮第四權角色，監察行政、立法、司法三權，維護公眾利益，民主國家將新聞自由奉為圭臬，美國憲法第一修正案規定國會不得制訂法律限制新聞自由。

香港《基本法》第27條訂明「香港居民享有言論、新聞、出版的自由」；《公民權利和政治權利國際公約》透過人權法案在港應用。有少數例外情況，新聞自由要有折讓，例如法庭審理風化案，法官禁止傳媒報道披露受害人身分；任何人包括傳媒披露廉署調查細節，受《防止賄賂條例》第30條規管，防止打草驚蛇；保障私隱、不得誹謗、不得藐視法庭，從新聞與言論自由的角度無疑是束縛，但這些限制建基於社會共識，經過正常立法程序。香港法例第1章《釋義及通則條例》第12部「新聞材料的搜查和檢取」保障傳媒機構保護消息來源，背後精神同樣是肯定新聞自由崇高的重要性，記者可基於公眾利益無畏懼地報道事實。

新聞自由不僅是一個行業的自由，是關乎公眾利益。警方日前拘捕壹傳媒負責人，百幾二百警員入報館肆意搜查近9小時，博懵檢視編採人員枱頭的資料，封鎖範圍不合理地廣闊並且不斷擴大，阻礙記者拍攝；壹傳媒大樓外，篩選部分記者可採訪警方發言人。

打壓異見報章，排斥不合意的傳媒，順我者昌逆我者亡。這邊廂新聞自由急速倒退，那邊廂香港從文明走向野蠻又多走了一步。
