暴政與法治
一片聲討律政司覆核雙學三子及東北案十三人刑期聲中，九月五日《明報》刊載英國前任刑事檢控專員LordMacdonald QC 的反駁文章，指出英國跟香港一樣，若檢控當局認為判刑過輕，也可以向上訴庭申請覆核刑期。在英國，若有人侵襲貼近國會重地，同時破壞財物、襲擊保安人員，多半難逃入獄，假如原判倖免，而英國律政司向法庭申請覆核，則法庭撤銷原判改判入獄，也絕對有可能。
文章當時的效果，是為惹起爭議的刑期覆核背書，令人深感失望。然而十月號的香港律師會月刊Hong KongLawyer 訪問Lord Macdonald QC，同一主題，信息卻大異其趣。
首先，在律師會訪問中，麥當納勳爵QC 指出了英國與香港不同之處是：在英國法例之下，檢控當局只可在重大刑事罪行判刑過輕的情况下，提出刑期覆核。例如與恐怖襲擊有關連的罪行。東北案與奪取公民廣場案的罪名，相去千里。但原來文章為何沒有提出？
更重要的是結語。文章題為「TheRule of Law is not a Movable Feast」，意謂不是在對己方有利才遵從，但訪問總結時卻指出： 「法治有賴合法、民主和人權，這些需要一一培育而相輔相成的價值。缺乏民主認受性的法律不會得人擁戴，不尊重人權的法律只是為暴政效力。」法治與暴政，得民心還是為人唾棄，這才是關鍵。
