法力無邊
2020 年聖誕佳節將至，難望聖誕快樂，但仍可祈求心靈的平安。趁此空間，或可反思一些平時無暇深究的根本問題，例如：我們需要更多法律嗎？過去一年，香港人領教到，法律可以是專政對付人民的大殺傷力武器。著名法律學者、前英國最高法院法官、香港終審法院非常任法官岑耀信（Jonathan Sumption） 提醒世人：「We cannot have more law without more state power to apply it.」——訂立更多法律，必然是給國家更多權力執法。對一個沒有民主制度制衡的地區而言，法律的潛在危險更顯而易見。岑老師這句話出自他的小書Trials of the State 頁18，很值得特別是法律界和法律學生細續此書。
警方以「洗黑錢」為名，凍結政治人物和團體的銀行戶口。打擊有組織及嚴重罪行的法律，原意是撲滅這些罪行，例如國際販毒活動，單單拘捕和監禁犯罪者是不足夠的，必須針對他們的犯罪得益。同樣，9．11 恐襲後，聯合國安全理事會認為，要打擊國際性的恐怖主義活動，必須切斷支持這些活動的跨國資源，所以要求各國各地訂立法例，凍結以至沒收涉嫌資助恐怖活動的資金財產。當年在立法會通過相關的條例，經過一場場激烈的辯論。一方面，我們都理解有需要，但另方面，我們擔憂缺乏有效制衡，這些權力被濫用，會禍害無窮。現在我們看到的，就是有法律、有執法大權而沒有制衡的後果。
加於公務員頭上的宣誓要求，世上是有的，但民主國家，不容許誓言侵犯公務員在憲制之下享有的自由（ 例見Cole v. Richardson, 405 U.S.676）。香港公務員有權知道，宣誓對他們切實約束的限制。
