法政隨筆 – 城規改革政府有責 梁家傑

 

上月尾，西摩道住宅發展項目上訴失敗，發展商可按照原訂計劃，獲得樓宇高度限制及地積比率的放寬。法庭的判決引起區內市民不滿，不少居民均認為，放寬高度限制，會增加附近一帶交通流量，及造成屏風效應。不過筆者認為，事件的核心問題並非來自法庭的判決，而是城規會機制本身的問題。

翻閱法官的判辭，我們不難理解其否決城規會上訴的理據。法官指城規會「錯誤地考慮了交通及景觀這兩項因素」，而兩者並非分區大綱圖的規劃準則，因而否決其上訴。

根據《城巿規劃條例》第13 條，城規會行使酌情權並不可考慮大綱圖範圍以外的規劃因素。按此推論，若城規會援引交通及景觀因素，便屬越權。在「必須顧及當初訂立大綱圖的規劃意圖」的原則下，上訴庭於是駁回了城規會的上訴。

將交通和景觀兩項因素列入規劃準則，筆者相信不少市民也會支持。然而，政府於九十年代制定規劃大綱圖的時候，卻忽略了交通和景觀的因素，導致西摩道一帶居民日後要承受屏風效應和交通問題。城規會經此一役後，權責以至法定地位都受動搖，事件所造成的傷害實在難以言喻。

城規會機制存在的漏洞其實還有很多，例如只限制高度卻不削減發展樓面面積等。面對機制存有的漏洞，業界早有要求城規會改革的聲音，可惜政府十八年來一直視若無睹。直至今天，發展商仍「合法地」興建筷子樓、屏風樓，到底政府要城規發展沉淪到哪一個地步，才願改革城規會呢？
