法政隨筆 – 獲得法律代表的權利
一九九七年七月一日，《基本法》生效之後，一如所料，大量抵港的港人內地所生子女要求當局發給永久居民身分證，承認他們的居留權，當局堅持先要將他們遣返。這些港人子女提出司法覆核，但一律被拒法援。
當時，大律師公會呼籲法律界義務代表這些港人子女，因為事涉重大憲制權利和基本人權，不能坐視申請人因缺乏經濟能力而得不到律師代表。公會的呼籲得到熱烈支持，一個上午就有逾百名律師及大律師簽名響應。當時臨時立法會主席范徐麗泰嘲諷： 「那麼多律師那麼喜歡免費做，就讓他們做好了，何需給予法援？」幸好法庭不作如是觀，港人子女終獲法援，上訴至終審法庭。
「法律之前，人人平等」；市民選擇法律代表代辯的權利，是法治的基石。為保障這個權利，是以律師不能因官司不受公眾歡迎而拒絕接案，而大律師的行為守則，也訂明了所有大律師都有這個義務。法援的存在，是避免訴訟人因缺乏經濟能力而得不到律師代表。
