法政隨筆 – 第三封信
終審法院於六月八日作出歷史性裁決＊，要求人大釋法。與一九九九年六月二十六日人大釋法比較，感受不同，卻是一般深切。十二年前，特區政府在法庭已作出終審之後，強行藉政治渠道，要求人大釋法，推翻終院裁決，令港人內地子女已獲得的居港權，一夜之間化為泡影，令萬眾矚目的特區司法獨立橫遭強暴，是急怒攻心，是不應出現的難在最意想不到的時候以最赤裸干預的方式出現。十二年後，這次釋法，感覺是要來的，終於到來。158（3）條是《基本法》的一部分，我們一直都知道，終於有一天，會出現158（3）條所說的情況，就是終院在審理案件時「需要對本法關於中央人民政府管理的事務或中央和特區關係的條款進行解釋，而該條款的解釋又影響到案件的判決……」
一旦出現了這個情況，終院別無選擇，就必定要請人大釋法。問題只是遲早，是到時終院關於這個情況是否已出現的裁決的理據是否令人信服，整個過程是否令人看到沒有政治干預司法獨立，這是特區法治的信心所繫。
請人大釋法的決定並非一致：五位終院法官之中，三位贊成，兩位不贊成。整份判決書長達二百頁。以我膚淺的法律修養，不贊成的兩位法官的兩份判決書，簡單明確，令人信服；贊成的三位法官的合併判決書邏輯迂迴，政策與法理混淆，法律的裁斷，竟可視為「外交」及「國家行為」，令人難以理解。請人大解釋的條款，就是關於「外交事務」、「國家行為」的第13 條及第19 條。
理據還可繼續推敲，但是國家的政治架構干預，卻已清楚記錄在案。在審訊過程中，北京外交部前後發出了三封信，藉律政司長分別在原訟庭（第一封信）、上訴庭（第二封信）及終院（第三封信）呈堂。第一、二封信還客氣，說是提供資料讓法庭參考，第三封信則露出鐵腕，明文指示： 「The regimeof state immunity concerns the foreign policy andoverall interests of the state, and theabove-mentioned state immunity regimeadopted by China uniformly applies to the wholestate, including the Hong Kong SpecialAdministrative Region.」一國一制，法律服從政治，還需要「釋」什麼「法」？
