燒《基本法》會失去參選╱就任議員的資格？燒《基本法》等於不擁護《基本法》？不是抗議當權者踐踏《基本法》？誰說的？

叫「結束一黨專政」會失去議員資格？新任常委譚耀宗如是說，《文匯》《大公》如是說，說了就是法律？記者問特首林鄭，林鄭的回應可圈可點：到時由選舉主任按照法律決定。為什麼身為特首也說不出是或不是？生活在香港法律之下的人，不是有權知道法律是什麼嗎？政府不是有責任解釋嗎？不是現在就可以知道，而不是等事情發生了才揭盅嗎？

照林鄭的說法，她也不知道「結束一黨專政」是不是違法。是否違法，她說，由選舉主任決定——這個「按照法律」說了等於沒說，因為誰也不知道按照什麼法律，也是要到時才知。換句話說，「法」治已變成人治，再不是公眾隨時可以檢核的清楚明確的規範。

變成這樣，是因為法庭有裁決，選舉主任有權審核及決定擬參選者是否真誠擁護《基本法》，若然不服，也只能在選舉結束之後挑戰。

「莫須有」的意思是「或者有」。燒《基本法》或者會被選舉主任斷定為不擁護《基本法》；呼喊「結束一黨專政」口號或者會被褫奪議席，都是避免做好了，誰有錢跟政府打官司？言論自由、信仰自由就是這樣消失的，「寒蟬效應」，上周梁耀忠建議泛民喊喊這個口號不果的活劇，就是展現公眾面前的即時例子。
