私人檢控非私事 梁家傑

民主黨立法會議員許智峯私人檢控去年10月駕車撞示威者的司機及11月西灣河開槍警長，律政司申請撤控，獲法庭批准。

私人檢控寥寥可數，1996至2000年法院處理共30宗私人檢控，律政司介入過一次，今年6月律政司司長鄭若驊網誌亦指出，過去10年很少量私人檢控。

私人檢控權利被稱為「一項寶貴的憲法保障，用以抗衡權力機關的慣性或偏頗作為」，律政司非不得已不應插手，應平衡兩方面的公眾利益，一是不容許有人無的放矢提出檢控對被告製造麻煩，二是不容許公義得不到彰顯。

私人檢控需要過兩關，先說服裁判官發出傳票，後說服律政司不接管案件。許智峯兩案通過第一關，表面證據成立，在起訴時限之內、屬於裁判法院管轄權、許智峯有權提告，裁判官才決定發岀傳票。

第二關被堵截，鄭若驊在6月網誌留下伏線，說明「不應容忍有人提出毫無事實根據甚至瑣碎無聊的私人檢控，或可能懷有不恰當動機或基於政治因素而提出私人檢控」，有責任終止「沒有合理定罪機會、違反公衆利益、基於不恰當動機而提出或構成濫用程序」的私人檢控。

兩案的司機與警長未被律政司公訴，已引起公眾譁然，現在律政司出手阻止私人檢控，惹來更大的包庇嫌疑。兩案受到廣大關注，乃公眾利益，律政司接管案件後，要求警方進一步搜證，然後決定檢控與否，才是正路。
