綠色公民 – 環評法的勝利 余若薇

東涌長者司法覆核挑戰港珠澳大橋環評，獲高院判勝訴。判決彰顯了《環境影響評估條例》對大型工程項目把關的影響力，確保發展與環保之間的真正平衡，這意義遠比港珠澳大橋落成日子稍為延誤重要。

環境保護署署長負責審批環評報告，簽發環境許可證，應為環評制度關鍵的把關人，但政府同為工程倡議者，角色矛盾。前環保署署長羅樂秉十年前否決落馬洲支線環評報告，成為經典案例。自此以後，曾蔭權政府以政務官取代專業職系的官員擔任環保署署長，令不少人擔心環評制度已死。

周一的司法覆核判決，說明政府若不依足該法例的法定要求做好每一個程序，市民亦可透過司法覆核，要求法院裁定環保署署長的決定違法，發還重做。
