飛出礦坑的金絲雀 梁家傑

終審法院非常任法官何熙怡任期七月底屆滿，拒絕續任。澳洲籍的非常任法官施覺民去年九月呈辭，坦言與去年六月生效的港區國安法有關。何熙怡是第二隻從礦坑飛出來的金絲雀，為香港敲警鐘。何熙怡臨別贈言，說無法預見自己什麼時候會想飛來香港。

視像系統參與審案便能履行職務，顯然，不是因為疫情窒礙她來港，她根本不願意繼續擔當此職。

我解讀何熙怡英式含蓄講話的意思是，已故法律界泰斗兵咸勳爵提出的法治八大原則，包括保障基本人權、人人平等、法律盡可能清晰和可預測等，在香港已褪色，港區國安法改變了司法的一些原則和法官思路，而國安法指定法官亦會審理不涉國安法的經濟訴訟。現時香港法院審理經濟案件的法治原則，能夠持守多久？何時在香港會有企業家像馬雲、馬化騰般遭遇？國際社會難以相信，國安法之下，本港營商環境和經濟案件繼續獲得良好的司法保障，仲裁制度繼續值得信賴。

光天化日舉行的民主派初選被當作違反國安法，未審先囚；非法集結量刑起點大躍進；王婆婆獨自一人「非法集結」被捕；支聯會副主席鄒幸彤什麼都未做就被「預防性」拘捕，都在複製內地那一套。

何熙怡是英國最高法院前院長，七十六歲，犯不着押上一生清譽，隨時要為國安法之下的香港司法新常態背書。我理解她的決定，但始終期望其他非常任法官與香港人一起堅守到不能再容忍之時。
