Do not make it easy
終審法院常任法官鄧國楨Robert Tang PJ 榮休，在法庭儀式上致辭，其中最令人難忘的結語是：「If we as a community insist on the rule of law, it cannot be taken from us easily. Do not make it easy.」在我的記憶中，在公開發言場合上談論法治的法官眾多，但沒有一人告訴公眾：不要以為你人微言輕，不要低估你的力量或放棄你的力量，香港有新聞自由，有自由選舉，要令你的聲音你的選票發揮力量。自由的代價的的確確是永不鬆懈的警覺。如果我們整個社會堅持法治，法治就不容易被奪走。不要令此事變得容易。不要令此事變得容易——此語可圈可點。強弱懸殊，世局瞬息萬變，誰知最後會怎樣？我們不能完全主宰命運，但至少要為自己的命運奮鬥，不要輕易屈服。人類的進步史，其實就是一部奮鬥史，不要低估自己的力量。
當然，記憶中也沒有法官在庭上鼓勵人用選票發揮捍衛法治的力量這些事。但是鄧國楨不是一般的法官，在任法官之前也不是一般的資深大律師，而是一向對香港有特殊的承擔。中英談判時期，他是上京面謁鄧小平陳述香港信心所繫的「才俊團」的成員；八九民運期間，他任大律師公會主席，與百萬人上街遊行。細讀他歷來以不同身分作的發言、判案書，不難看到這位洞悉世情而不失初心的法官對人權法的重視。我們未必贏，但毋須一早認輸，不要讓任何人相信我們會輕易讓法治被奪走。
