「時光共享」會籍合約公司手法卑鄙 要求參考外國法例就冷靜期立法

消委會今天點名譴責銷售「時光共享 (Timeshare) 」會籍公司Great Time Universal (HK)，利用高壓手法推銷會籍合約。
公民黨立法會議員陳淑莊表示，有關個案事態嚴重，其推銷手法甚至涉及刑事威嚇及禁錮成分，要求執法部門盡早作出調查和採取行動。雖然有關公司投訴數字曾一度回落，現時不單故態復萌，更加變本加厲，有投訴人的供款期甚至長達17年，至2035年才結束，之後才可享用會籍機會，涉事公司做法卑鄙，陳淑莊要求政府盡快為消費冷靜期立法。
陳淑莊指出，參考不同國家做法，英國就多類產品或服務設立7 至14日冷靜期，更早於1992年已為「時光共享 (Timeshare)」合約作出立法監管。根據於2010年更新條例，The Timeshare, Holiday Products, Resale and Exchange Contracts Regulations 2010，「時光共享 (Timeshare)」合約需設14日解除合約期，而且消費者並不需為退出合約以承擔任何費用。
陳淑莊續指，公民黨一直向政府爭取就冷靜期立法，保障消費者權益，但至今仍只聞樓梯響，而因《商品說明條例》定罪門檻高，單靠有關條例規管，難以杜絕坊間各種不同的不良銷售手法。
對於是次事件，陳淑莊建議消委會利用消費者訴訟基金，為個別明顯違規或特別嚴重的個案展開訴訟，倘若案件勝訴，有助杜絕往後的不良銷售事件。
