人大釋法既無必要亦是錯誤決定 公民黨籲尊重法庭裁決

高等法院於今日就梁頌恆及游蕙禎兩位候任議員宣誓的司法覆核案作出裁決。公民黨表示尊重法庭裁決。

立法會議員郭榮鏗認為與訟的任何一方如對裁決不服，均可循既定的司法途徑上訴；社會對法庭的裁決的意見及評論，亦可在尊重法庭的前提下討論。法官在裁決第116至126段表明，無論人大常委會有沒有釋法，均不影響其裁決。此外，法官亦特別指出，人大常委會於11月7日的釋法是否符合基本法第158條規定，是有爭議的，將會在其他案件中處理。郭榮鏗認為，由此證明人大釋法毫無需要，人大常委決定釋法亦是一個錯誤的決定。

公民黨指出，判詞清楚說明基本法已賦予香港三權分立，不容置疑，足以反駁早前有建制人士指香港沒有三權分立之言論。
