保密協議涉非法行為 中科不受協議約束 可全面披露工程資料

今天，負責沙中綫紅磡站擴建工程，層板混凝土部分的分判商中科興業有限公司，首度發出新聞稿回應事件，在向總承建商禮頓的監督人員及高層通報短筋事件後，被警告需要遵守保密協議，因而未能向傳媒披露任何內容。公民黨議員陳淑莊認為，若保密協議涉及不法行為，例如串謀詐騙，保密合約將無效，即是雙方不受協議約束。陳淑莊希望中科盡快諮詢法律意見，在現時涉嫌工程造假、隱瞞及串謀詐騙的情況下，保密協議是否仍然有效，並因此可否全面披露合約內容，政府當局亦可因此尋求執法人員調查，而毋須等待港鐵提交報告。

另外陳淑莊認為，中科身為事件的吹哨人（whistleblower），令公眾關注是次重大事件，反而被禮頓警告，犯法人士卻能逃之夭夭，不應該在法治社會中發生。
