公民黨回應袁國強尋求人大釋法事宜

今天（13日）律政司正式向終審法院建議尋求全國人大常委會澄清1999 年《吳嘉玲案》釋法時，附帶提及的基本法籌委會報告是否屬於釋法內容的一部分，以圖解決「雙非」問題。

公民黨明白市民高度關注「雙非」嬰兒的問題，我們一貫立場是反對「雙非」孕婦來港產子，更是第一個要求政府取消「雙非」分娩配額的政黨。我們認為，修改《基本法》是最符合法治和最能徹底解決「雙非」問題的有效途徑。

現時我們尚未知道，律政司要求終審法院尋求人大常委會釋法的具體內容，由於茲事體大，涉及重要公眾利益，我們要求律政司立即披露其對終院的建議，以確保其要求是符合《基本法》程序，但無論如何，律政司不斷要求終院尋求釋法，勢必衝擊普通法在香港的實行。

行政長官梁振英及律政司司長袁國強曾多次公開表示，盡量不以釋法來解決「雙非」問題，但政府當局今日卻違背承諾，做法令人遺憾。而律政司作為與訟一方，向終院提出尋求人大釋法的建議，效果是要求終院推翻其十二年前的判決，做法極其不恰當。
