公民黨就保安局以《社團條例》取締香港民族黨之聲明

今日中午，保安局局長李家超會見記者，表示正在考慮根據《社團條例》第8條禁止香港民族黨運作。他提到香港民族黨將有21天時間申述，收到書面回覆後會再作決定。
雖然公民黨不支持香港民族黨的主張，但對事件感到震驚及遺憾，保安局的舉動無疑是政治打壓。公民黨強調，根據《基本法》第二十七條，香港市民享有結社自由，《香港人權法案條例》第十六條亦保障香港市民持不同意見而免受干預的權利。局長引用「國家安全」作為理由，但所謂「國家安全」定義模糊，政府可隨意濫用，對香港人構成人權威脅。
在今次事件之前，《社團條例》從未用作規管政治團體。在過去，《社團條例》主要用於規管三合會，回歸以來亦未曾有過運用此條例禁止任何社團運作的先例。直至目前為止沒有證據顯示香港民族黨曾經從事非法活動，政府打壓一個政黨猶如對待三合會，令人費解。
公民黨重申，香港市民依法享有持政治主張而不受干涉的權利，亦看不到香港民族黨如何影響「國家安全」和「公共安寧」。公民黨不能接受局長以此藉口禁止政治團體運作、干預結社自由。我們促請政府遵守《基本法》及《香港人權法案條例》，切勿對香港民族黨作政治檢控。
