公民黨提出《2018年災難狀態條例草案》

經歷颱風山竹蹂躪香港，揭發特區政府反應遲緩，今日（10月4日）公民黨提出《2018年災難狀態條例草案》私人條例草案，向政府就相關機制作出立法建議。

行政長官林鄭月娥表示政府「並無法律基礎」去宣佈停工，但政府本來可以採取行政手段宣佈非緊急公務員停工，以及宣佈兩間認可交易所停市，以身作則。這次超強颱風襲港揭露香港政府缺乏處理災難的機制，促使公民黨起草災難狀態條例草案。

條例訂明災難狀態是指在威脅人命、危害財產、在香港造成廣泛破壞、帶來救災及善後作業需要的自然災害或意外的時候，行政長官及行政會議可根據條例宣佈進入災難狀態，啟動災難應變委員會，並由行政長官主持災難應變委員會的會議。

於災難狀態下，緊急服務以外的整個公務員系統停止提供服務，除非政府部門首長另有安排；而兩間認可交易所則需要停止提供服務及停止設施運作。條例亦訂明，私人機構僱員有權在災難狀態下缺勤，而僱主不得扣減工資或辭退僱員，缺勤的日子亦不作年假或任何假期計算。如僱員在災難狀態下的上班或下班途中遭遇意外，僱主有責任作出補償。若僱主懲罰員工在災難狀態下缺勤，一經定罪，最高可處第5級罰款（$50,000），此建議參照了僱主不給僱員休息日或拒絕批出產假的罰則。

公民黨在起條例草案期間，參考了其他實行普通法的國家的法律，包括英國、澳洲、紐西蘭及美國的法律。在起草的過程中，許多決定都借鑑了他們在處理災難方面的智慧。公民黨認為香港在這方面應該與國際標準看齊，以造福市民。
