公民黨黨魁梁家傑去信立法會主席 誓保立會監察權

梁家傑就裁決與主席商榷　誓保立會監察權

特首梁振英於昨天到立法會陳詞後，未設議員提問環節。在公民黨梁家傑議員要求下，立法會主席曾鈺成裁決，議員無權向特首提問或要求澄清細節。

梁家傑認為，雖然《議事規則》中並無明文指出，議員能對行政長官的發言作出提問或澄清，但未有明文規定，不等於議員沒有相關權力。而《議事規則》第28條亦列明，若「受委派的官員」到立法會發表有關「公共利益」的聲明，主席可准許議員提出簡短扼要的問題。

上述「受委派的官員」的委派人正是行政長官。故當行政長官本人出席立法會會議時，他對立法會履行的責任，不應亞於受他委派的官員。按此邏輯，議員應同樣有權就特首發出的聲明，作出提問或要求澄清。

就此，梁家傑議員已去信主席，要求將此事宜交付議事規則委員會，作出詳細討論。
