嚴正要求梁君彥下台 讓議會重新出發

10月26日立法會會議席上，梁頌恆議員、游蕙禎議員和劉小麗議員按時出席，要求並根據《議事規則》第18條進行宣誓。但是，立法會於足夠法定人數下，立法會主席梁君彥並無按法律和《議事規則》的要求，安排三名議員宣誓。當有議員提出規程問題時，梁君彥未聽問題，便即時表示沒有規程問題。最後，梁君彥便宣佈休會。我們認為，梁君彥完全缺乏主持會議的能力，實在無法勝任主席一職。因此，我們促請梁君彥立即辭職，由議員重選一位可以嚴格按照法律和議事規則行事的主席，讓議會重新出發。

《宣誓及聲明條例》第19條載明立法會議員須於其任期開始後盡快作出立法會誓言。《議事規則》第18(1)(a)條規定了宣誓在一般會議議程中的排序是最先進行，而第19(2)條亦說明立法會宣誓是可以無須作出預告而進行。上周代表立法會主席的資深大律師翟紹唐在宣誓事件中的司法覆核緊急聆訊中亦言明，立法會主席有憲法責任，捍衛所有選舉產生的議員的權利，而禁止他們再宣誓是對其憲法權利的重大干預。梁君彥於10月18日的裁決中亦表明：“如梁議員及游議員提出書面要求，我會准許兩人在立法會會議上重新宣誓。”

然而，梁君彥卻在10月26日的會議席上，屈從於政府和建制派的政治壓力下，讓政治凌駕法治，拒絕依法讓梁頌恆和游蕙禎議員進行宣誓，完全放棄了主席需要捍衛立法會議員憲制權利的應有責任。

我們必須團結一致，守護香港的法制，捍衛議會的尊嚴。我們歡迎各位市民一起聯署，促請梁君彥立即辭任立法會主席，令議會可以重新出發！
