回應地監局新規管建議

回應地監局新規管建議

就地產代理監管局今午提出加強監管地產代理措施，建議禁止地產代理在未經發展商確認資料的情況下，自行向準買家發出售樓書及價單，以及向客戶提供有關樓盤的宣傳品時，須獲發展商書面確認資料無誤等。惟本人認為有關的新建議，雖然對物業代理的監管有一定的幫助，但未必能夠發揮顯著作用。

本人認為地監局必須嚴格執行有關的新建議，包括規管地產代理向準買家提供的所有資料以及所作出的陳述，必須先獲得發展商的確認，以杜絕物業代理隨意就樓盤的資料作出陳述，誤導準買家；而地監管亦應加強其角色的主動性，要求地產代理於開始銷售前將所有宣傳資料交予地監局存檔。最重要的是地監局必須做好其本份，嚴格執行指引，打擊不良的銷售手法。

同時，本人認為新措施並未切中現時問題的核心，更未能有效回應現時一手樓銷售缺乏規管的問題。地產代理監管局的職權只能針對地產代理，但在政府方面，對於發展商目前的規管架構仍然沒有任何監管，特別是舊契樓的發展商，仍是「無皇管」。對此，本人感到頗為失望。

本人認為政府當局應盡快引入法例規管一手樓銷售，以全面的法律框架規管地產發展商的行為，從根本處理當前的問題，而地監局亦應盡快公布Icon事件的調查結果。本人將繼續跟進有關一手樓銷售監管的問題，並密切留意新措施落實後的效果。
