保障業主權益

公民黨立法會議員湯家驊今天就強制驗樓計劃，向發展局局長陳茂波進行口頭質詢，並要求當局盡快修訂法例，堵塞漏洞，防止法團藉維修計劃從中取利，貪污等。惟當局未有承諾，盡快修訂法例，湯家驊議員就此感到遺憾。

自屋宇署於去年中展開強制驗樓計劃後，湯家驊議員近日接獲不少樓齡只有逾20年的屋苑業主求助，指其屋苑法團尚未收到屋宇署的法定通知，並在大多數業主不了解法團的計劃下，法團已展開勘察工程，及進行涉及龐大費用的維修計劃。

湯家驊議員指，有不少業主向他求助指，他們無法查證維修工程是否有必要進行，並在他們未知悉相關工程的情況下，業主大會已投票通過維修計劃。湯家驊直指，不少業主大會僅以出席業主輕微的過半數業權份數、通過贊成維修計劃。當中，更有維修工程造價涉及近三億元而支持通過的業權份數卻不足三成！
湯家驊議員直指︰「由於未來數年，愈來愈多樓宇需展開維修計劃，當中涉及數千幢樓宇。每項工程均涉及龐大的維修工程費用。假若法例容許輕微的過半數業權份數，便可通過展開維修工程。這個漏洞容易讓人從中取利，甚至有貪污的可能。」湯家驊重申，有見當局漠視法例漏洞和小業主權益，正積極考慮研究提出私人草案堵塞法例漏洞，要求業主大會需獲得過相當業權份數贊成，才可通過涉及龐大費用的維修工程計劃。
除此之外，湯家驊亦關注有不法之徒以圍標的方式，取得多個屋苑的大型維修合約，謀取暴利。湯家驊直指，現時《防止賄賂條例》只規範政府工程之圍標為刑事行為，而並不包括私人工程之圍標行為。湯家驊促請政府盡快修改《防止賄賂條例》，杜絕私人工程圍標行為，保障屋苑業主權益。
