公民黨就「截取通訊及監察事務專員向行政長官提交2011年周年報告」的初步回應如下：

截聽專員在報告第12.4及12.5段指出，他期望條例所指的執法機關完全符合法律規定去進行截取及秘密監察行動，但今次的報告仍然令他失望，其中一個原因是執法人員在履行與條例相關的職責時，敷衍散漫。另一個原因，是專員之前提的建議未被採納，以致無法向執法員施以有力的阻嚇。

公民黨認為，截取和秘密監察市民的通訊和行事，是極之敏感，並且有可能侵犯市民基本權力之事，執法部門在任何情況之下，都必須認真和嚴肅處理。根據專員的意見，發現有執法人員對市民的基本人權採取輕視和草率的態度。公民黨指出，執法部門的主管有必要督促負責相關的執法人員，提高尊重人權的意識。

此外，條例立法至今已經超過5年，當年在立法審議時，公民黨吳靄儀已經明確要求加入「日落條款」，目的是要強制政府部門作出適時的檢討。當時政府曾承諾過進行檢討，但至今仍未見有關當局作出實際行動。公民黨要求政府必須立即展開檢討工作，並且提出修訂，改善條例的漏洞，讓市民的權利不會受到無理侵犯。
