支持司法機構就攜帶電話進入法庭制定新指示

司法機構今日發出實務指示35，訂明公眾人士在出席有陪審團參與的法律程序時，必須完全關掉所有流動電話及任何其他有攝影或錄影功能的器材，並將之放在其袋子／口袋內。該指示亦確立法庭使用者擕帶流動電話及攝影器材進入有陪審團參與的法律程序的法庭時，已被視為已同意讓法庭或獲授權人士搜查或檢查其器材是否已關掉，或曾否向法庭内任何人士或任何地方攝影或錄影。不遵從該實務指示者需負刑事責任。

立法會法律界議員郭榮鏗認為新指示符合現時需要，以及能夠回應近期多宗與此有關的事件。他指出，現時絕大部份手提電話均有攝錄功能，而法庭向來對在庭內使用電話通訊、使用電話或其他攝錄器材進行拍攝或錄影均有限制。新實務指示清晰表達有關限制，而且將更有效避免任何人在法庭拍攝或錄影。郭榮鏗重申，新指示是為了確保陪審團不受任何干預、壓力或分散他們注意力的事情所影響，對公平公正審訊極為重要，呼籲公眾遵守禁止使用電話及攝錄器材的規訂。

此外，郭榮鏗建議司法機構增加保安人手，以免再發生妨礙司法公正或騷擾法庭程序的事件。郭榮鏗曾在立法會司法事務委員會提出司法機構應增派人手以維持法庭秩序。他指，在法庭內看守犯人的懲教人員、協助法官的秘書、以至法官均無暇分心留意公眾席的情況。司法機構應考慮在每個法庭派駐庭警，特別是受到公眾關注的案件，留意公眾席有沒有人拍攝或做出不恰當行為。
