曲解法例 誤導公眾 規劃署官員應重溫《駐軍法》

上星期，規劃署一位總城市規劃師表示，當軍用碼頭出現破壞社會安寧及治安的情況時，便由警方介入及執行法律，駐軍僅肩負香港防務的責任。她更表示，署方明白市民和城規會委員都希望取得軍用碼頭的開放時間表，以釋除公眾疑慮，但城規條例僅賦予署方列明土地用途，卻沒有賦予權力規管碼頭的開始時間，未能具體訂立碼頭的開放時間表。

今日，規劃署同一位總城市規劃師公開表示，政府當局將會於中環解放軍碼頭用地外圍興建三道電閘，於解放軍碼頭有軍艦停靠時關上，限制市民進入，而平日則會開放予公眾使用。該名規劃師又表示按照《駐軍法》，解放軍碼頭用地若劃為軍事用地，將會由解放軍駐港部隊使用和管理，但又同時表示政府當局會按照本地法律執法。

本人認為此說法反映政府人員不完全理解《駐軍法》，而且上述解釋自相矛盾，本人認為政府官員含糊其辭，誤導城規會及公眾。

城規會正處理由政府提出將中環海濱約3萬平方呎的休憩用地改變作軍事用地。按照《駐軍法》，軍事用地只可以用作防務，第二十六條明確表示「香港駐軍的國防等國家行爲不受香港特別行政區法院管轄。」香港執法機構在獲得駐港部隊同意下方可進入軍事用地。至今，政府當局仍然沒有提供具說服力的理據，本人要求規劃署或政府當局立即作出澄清，釐清用地內的執法權和所執何法的問題，以免公眾產生錯誤印象。
