歡迎終院就外傭案的裁決 敦促政府絕對不能尋求人大釋法

公民黨歡迎終審法院今日（3月25日）就外傭居港權案作出的裁決。公民黨一直認為律政司要求終審法院就案件提請全國人民代表大會常務委員會（人大常委會）釋法，是絕無需要及法律基礎，終審法院亦正正是基於這兩個原因駁回律政司的要求。

公民黨敦促政府尊重終審法院這個最終及結論性的裁決，不要尋求人大釋法，否則必然會為香港的法治帶來無可補救的破壞。

公民黨尊重任何人均有尋求司法覆核以及法律代表的權利。公民黨多次重申，司法覆核並不表示亦不會導致外傭在留港7年後可自動獲得居港權。終審法院今日的裁決彰顯了香港三權分立的原則，法庭會獨立地依據法律去處理法律問題。政策問題應由行政機關處理。公民黨相信行政措施是禁止雙非母親來港產子的最有效方法。如有需要，應以修改《基本法》來一次過解決這個問題。
