無視法律 誤導港人 堅決反對政府向解放軍送地

今午立法會發展事務委員會討論中區海濱解放軍碼頭事宜，陳茂波局長和一眾政府官員在會上反覆強調把接連軍事碼頭的用地劃為軍事用途在過去多年已多次提及，不存在隱瞞市民的情況。但本人認為政府當局仍然無視《駐軍法》的規定和有關規定可能帶來的影響，更一再混淆軍事碼頭和軍事用地的概念，本人對此感到極度遺憾。對於本人在會上動議的議案遭否決，本人並不感到奇怪，但一眾建制派議員為求為政府開脫而顛倒是非，實在令人感到憤怒。本人認為：

1.    市民根本不反對興建解放軍碼頭作停泊軍事艦隻之用，市民的關注是他們一直都未能清楚知悉毗連碼頭的0.3公頃土地會劃為軍事用途，並交由解放軍管理；政府當局和一眾建制派議員不可能以市民不反對軍事碼頭的興建，就視市民已同意把0.3公頃土地交予解放軍；

2.    政府當局必須澄清解放軍碼頭的0.3公頃土地如何受《駐軍法》影響；根據1994年的中英軍事用地協議及《駐軍法》，解放軍的軍事用地只可作防務用途，其使用權不得交予他人作非防務性質的用途，政府當局從來沒有解釋在這規定下，將如何安排把該土地開放予公眾作公共休憩空間；

3.    城市規劃委員會必須認真詳細地考慮市民提出的意見，並發揮其獨立的角色，以專業審視政府當局更改土地規劃的申請，絕對不能淪為政府當局的橡皮圖章；市民應該把握最後的機會，向城規會表達意見；
