盡快落實 嚴格執法 訂立公眾申述及上訴制度 私營龕場規管法例仍存疑慮

食物及衛生局局長今天公佈《私營骨灰安置所條例草案》，本人對此表示歡迎，因經多年的努力後終能爭取政府提出一套較全面的私營骨灰龕場規管機制，但縱觀整個條例草案，本人仍然覺得存在一些疑慮，需要政府當局積極跟進。

條例草案豁免1990年以前已開始存放骨灰龕的骨灰安置所領牌，但部份此等存在已久的龕場早年只是小規模經營，至近年才窺準骨灰龕位的商機而大規模擴張業務，本人關注即使這些龕場獲豁免領牌後不能出售龕位，但現存的大量龕位已對附近市民和社區構成影響將完全被乏略，政府當局在審批有關龕場的豁免書申請時，必須加以考慮，並建立公開透明的公眾申述及上訴制度。

本人亦促請各相關執法當局在條例草案通過前後均嚴肅執法，不應縱容違規經營的龕場，確保龕場符合地政規劃許可及樓宇結構的規定。同時，本人亦要求政府當局提出切實可行的措施，處理因私營龕場關閉而產生的暫存骨灰位置的需求，以保障現時已購買違規龕場龕位的消費者的合理權益。
