立即檢討法例 加強公眾宣傳 旅館發牌市民有權發聲

立法會民政事務委員會今天就旅館發牌和規管機制進行討論，本人對政府當局的消極態度感到相當不滿。事實上政府當局可以透過不同的措施完善現行的旅館發牌制度。本人認為民政事務局應立即檢討《旅館業條例》，並確保持牌旅館符合消防、結構和地契條款。本人認為

1. 根據現行《旅館業條例》第13條，任何人均可以就旅館牌照的審批結果提出上訴，惟政府當局並沒有積極向公眾傳達有關訊息；既然公眾可以就旅館發牌事宜提出上訴，政府當局應該透過便捷的渠道向市民提供牌照審批的詳情以及傳達市民可以提出上訴的訊息

2. 除大廈公契公以外，大廈的地契條款亦會對大廈的用途作出規限，政府當局在審批旅館的牌照申請時，應該考慮地契條款有沒有對經營旅館有相關的限制和規定，而不是單純以消防和屋宇結構作為審批的條件，因此應修訂相關條文，進一步保障居民權益。
