粗暴釋法遺禍 違背法治原則 議會勢將失守 團結方求民主

民主派四名立法會議員包括劉小麗、羅冠聰、梁國雄、姚松炎今日(7月14日)被法庭裁定去年宣誓無效，喪失議員資格。公民黨認為，這宗案件在法理上值得商榷，政府藉故起訴民選議員，與全國人大常委會聯手，蓄意尋求禠奪個別議員的資格，如此違反選民意願及公義的事情原本就不應該發生。

前特首梁振英與民為敵，去年入稟高等法院司法覆核上述四名議員的資格，加上人大釋法，為行政立法關係帶來史無前例及無可挽回的破壞，間接將四名議員所得共127,087名選民投下的票變成無效。連同早前被褫奪議席的兩位議員梁頌恆及游蕙禎，等同推翻185,727選民選擇的選舉結果，是民主制度一大倒退。

這宗案件牽涉的釋法本身粗疏、不按程序，違反法理和一國兩制，香港法院在現有制度下按釋法版本對這宗案件作出裁判，不會作出正確的判斷及判決。這次釋法本質就是直接修改本地法例，甚至僭建本地法律，有違反法治原則。

公民黨認為，今日四位被褫奪議席的四位民主派朋友就任立法會議員一年以來盡心為民，竭力監察政府，表現優秀。這四席真空之後，民主派直選議員在立法會的關鍵否決權失守；法治受損，議會制衡力量勢危，全港市民無一可獨善其身。

公民黨與民主派朋友們將會繼續毋懼打壓，竭力頑抗。公民黨呼籲民主派及廣大支持民主的市民團結一致，沉着應戰。
