警方再次不合理地延後拘捕 公民黨感遺憾

社運人士楊匡於示威結束一年後，始被警方因非法集結罪拘捕，公民黨對此感到不解及遺憾。

 

早前，警務處處長曾偉雄在回應多名社民連成員被延後拘捕時指，「警方在收到律政司指示後已盡快致電相關人士」。其後保安局又稱，在某些個案中，負責律師需要相當多時間審視證據、分析案情，似乎有意將延後拘捕的責任推卸律政司。

 

公民黨認為，上述罪行一般不牽涉複雜的法律論點，以長達一年時間進行調查及分析，並不合常理。而律政司刑事檢控科亦有服務承諾，會於14個工作天內回覆執法機關提出的法律指引要求及檢控決定查詢，即使問題較複雜，亦會於限期內給予初步回覆。警方並無充份理據多次延後拘捕示威者。

 

公民黨認為，延後拘捕不僅對相關人士造成不必要的困擾，亦會令社會大眾懷疑，警方是按香港法例不偏不倚地執法，還是因政治理由而對個別人士「秋後算帳」。如延後拘捕屬律政司責任，律政司應向公眾解釋未能維持服務承諾的原因；若否，則警方不應推卸責任，並向公眾交代真正原因。

 

梁家傑曾於3月中去信保安局局長黎棟國，要求就過去多次延後拘捕事件會面，惜至今未獲回覆。公民黨將繼續跟進。
