郭家麒要求發展局局長向公眾詳細解釋行政長官物業僭建個案

陳局長：

要求發展局局長
向公眾詳細解釋行政長官物業僭建個案

今天      閣下在立法會會議上回覆本人就行政長官僭建物業的質詢，可是本人仍沒有得到任何正面回應；亦有7位議員因為　閣下東拉西扯、拖延時間，未能追問。就此，本人詳列以下問題，希望　閣下能儘快回應－

（一）今天　閣下指梁振英以自行建造的磚牆密封地下室，屬於可被豁免的建築工程，其法律理據如何？為免引起公眾混亂、誤墮法網，請詳述現行《建築物條例》的豁免準則；

（二） 根據《建築物條例》，即使建築工程可被豁免，業主仍須在工程完成後14天內，向建築事務監督提交完工證明及相關資料，否則違法。就行政長官自行處理僭建物個案，他有否向當局提交完工證明及相關資料，具體日期為何；如行政長官沒有遵照法例規定，在14天限期前沒有提交完工證明及相關資料，當局會否作出果斷執法及檢控行動；

（三）屋宇署處理兩位行政長官候選人的僭建個案，手法亦厚此薄彼。屋宇署人員當時在短時間內攜帶檢驗儀器進入唐英年約道大宅偵查，並召見涉案人員；

至於梁振英僭建個案，屋宇署人員6月26日已進入其山頂物業視察，並發現一幅與原來建築圖則不符的外牆，但當局只是4次致函有關人士，即使梁振英一直未有回覆，直到11月23日他發出書面聲明，表示已拆除和及以磚牆密封200呎（實為320呎）僭建地庫及承認事前沒有通報屋宇署，當局才到上址破牆檢驗；

由於當時唐英年僭建事件嚴重影響行政長官選情，令梁振英成功當選，本人認為　閣下要立即作出徹查，向公眾開誠佈公，否則特區政府公信力將受極大打擊及影響前線公職人員士氣。

事關重大，本人希望發展局局長  閣下嚴肅處理上述問題，並儘快向公眾交代。如　閣下有具體安排，請與本人聯絡。順祝
