郭榮鏗擬就警方協助執行禁制令提緊急質詢 公民黨立法會議員郭榮鏗於今日向立法會主席要求在星期三的立法會大會上，就警方協助執行有關佔領運動的民事禁制令事宜提出緊急質詢。質詢內容附於此新聞稿供各位傳媒朋友參閱。 _________________________________________________________________

警方協助執行高等法院就旺角部分街道和金鐘中信大廈出入口禁制令申請所發出的命令的事宜 高等法院於2014年11月10日就三宗涉及堵塞旺角部分街道和金鐘中信大廈出入口批准發出禁制令，禁止佔領人士妨礙執達吏拆卸或移除在指定地方的障礙物，又授權警方在有合理理由相信任何人可能妨礙或干擾執達吏執行禁制令的情況下展開拘捕行動，並將被捕人士盡快帶至高等法院尋求進一步指示。

及後，高等法院於2014年11月14日批出命令，列明警方亦可基於《警隊條例》第51和52條，拘捕並扣留涉嫌干犯其他刑事罪行的佔領人士。而警務處處長表示警方會全力協助原告人執行有關民事禁制令，律政司司長亦多次強調這次行動並非清場。鑒於可能被捕的人士眾多，場面混亂及被捕人士極有可能在未清楚自己是基於何等罪行而被警方拘捕。

就此，政府可否告知本會： （一） 警方在展開拘捕行動時，如何確保佔領人士清楚明白涉嫌違反的禁制令的內容，及有機會決定停止違反禁制令的行為以免被捕？
（二） 若警方同時基於違反禁制令及其他刑事條例而拘捕佔領人士，則警方在甚麼情況下會將被捕者帶往高等法院尋求指示、甚麼情況下拘留於警署及／或帶往裁判署審理？
（三） 若被捕者以違反禁制令的理由被帶往高等法院，政府當局有何措施確保該等被捕人士得知其合法權利及能得到律師代表？
