郭榮鏗認為律政司有責任協助雙非兒童加入外傭居港權案訴訟

就律政司司長在外傭居港權案中，建議終審法院提請人大常委會釋法，以解決外傭及雙非兒童的居港權問題，立法會法律界議員郭榮鏗曾於2013年1月17日致函律政司司長袁國強，表示由於其建議涉及雙非兒童的居港權，基於程序公義和公平審訊的原則，雙非兒童表完全有權加入訴訟，而律政司亦須通知及協助雙非兒童參與外傭居港權案的聆訊。律政司司長袁國強於2013年2月5日回信，表示政府無責任亦無意通知或協助雙非兒童作為受影響人士加入訴訟。郭榮鏗與律政司司長的往來書信，請看附件。
郭榮鏗對律政司司長的回應表示失望，認為律政司司長未克盡其捍衛法治和公義的責任，因律政司作為提出該建議的一方，而案件又涉及重大的公眾利益，受影響的雙非兒童亦未必知悉或有能力自行加入訴訟，故律政司完全有責任去通知和協助他們參與該案件的聆訊，讓終審法院法官有機會聽取他們的意見，從而作出最公平、公正及合乎法治的判斷。
