郭榮鏗：只由中國公民出任終審庭法官的建議違反基本法

日前，清華大學法學院副教授程潔和身兼政協的基本法研究中心胡漢清，提出終審庭的法官應全數由中國公民出任。

公民黨法律界議員郭榮鏗認為程潔教授和胡漢清先生的言論，是基於完全不認識《基本法》第92條的意義而發表的錯誤言論，因《基本法》第92條訂明：香港特別行政區的法官和其他司法人員，應根據其本人的司法和專業才能選用，並可從其他普通法適用地區聘用。這樣說明《基本法》已表明在選用法官和其他司法人員時，最重要的考慮因素，是候選人的司法和法律專業。

郭榮鏗認為，程潔教授和胡漢清先生的言論，是繼梁愛詩批評香港法官不熟識中國與內地的關係而錯誤判案的言論之後，另一輪對法官的攻擊。本港法律界和香港市民必須警惕和反對這些言論，以防香港的法治精神和司法獨立受到衝擊和破壞。
