關注違規龕位傾銷 要求完善條例上訴機制 雙管齊下保障市民權益

食物及衛生局局長明天將會把《私營骨灰安置所條例草案》提交立法會進行首讀，展開立法會就該條例草案的審議程序。本人盼望議會能在最短的時間內完成草案的審議程序，使各私營骨灰龕場納入規管。但是，本人認為政府當局現階級必須加強跟進違規龕位傾銷活動，而條例草案仍有漏洞，政府當局必須正視並作出適當回應。

鑒於現有的違規骨灰龕場在條例草案生效前仍然可以出售龕位，條例草案的審議期即成為空窗期，現時違規並有可能不獲發牌的龕場可以把握這段期間向市民傾銷龕位，因此條例草案的審議期必須具效率，在空窗期間，政府當局亦應繼續向消費者發放訊息，提醒他們不應在條例通過前購買違規龕場的龕位。

為進一步打擊違規龕場傾銷龕位，各執法部門如規劃署、地政總署及屋宇署應在條例草案審議期間加強執法，以有效打擊違規龕場的運作，避免在空窗期內購買龕位的消費者權益受到損害。

條例草案就牌照申請設有上訴機制，惟只有骨灰龕營運者才能提出上訴，本人認為其他受骨灰龕場位置或運作影響的持分者亦應獲得提出上訴的權利，以保障該等持份者的合理的申述權益，在規劃過程中達致平衡，政府當局必須就此作出考慮。
