促請立即糾正藝發局選舉制度

於今天舉行的《2013年香港藝術發展局(修訂)條例草案》委員會會議上，政府當局自揭過去多屆藝發局各藝術範疇代表的選舉的制度，均不符合《香港藝術發展局條例》的規定，令本人感到相當震驚，更突顯了政府對香港藝術發展局的態度敷衍塞責。本人認為政府當局必須立即作出糾正。

根據《香港藝術發展局條例》，藝發局各藝術範疇代表的選舉只容許以團體名義登記為選民，但過去多屆的選舉中早已引入藝術工作者可以個人身份登記為選民的安排。此舉明顯不符合法例規定，本人十分詫異政府一直未有及早作出糾正。

讓人關注的是，新一屆的藝發局藝術範疇代表的選舉已經展開，如是次法例修訂未能及時獲得通過，根據立法會法律顧問的意見，新一屆代表的選舉的合法性極可能受到挑戰。但政府當局的代表在會上明言會以「行政措施」代替，更認為由行政長官委任經不符合現行法例產生的代表入藝術發展局將不會有問題。惟本人認同法律顧問的意見，認為政府無可能在明顯違法的情況下以「行政措施」處理，因為此舉有違法治精神。

本人呼籲各藝術界別的人士必須密切注意條例草案的審議工作，並積極表達各位的關注和意見。本人將繼續積極參與條例草案的審議工作，確保藝發局的選舉制度能在合法的前提下，選出具代表性的藝術工作者進入藝發局，為香港的藝術發展出力。
