執法不力 形同投降
對政府放生違規龕場感震驚

政府當局在今早舉行的立法會財務委員會特別會議上回應本人的提問時，表明若違規骨灰龕場內已安放先人龕位，考慮到孝子賢孫的感受，未必會以很大力度執法，本人對政府當局的回應感到震驚，因為此回應等同向違規龕場發出訊息，若龕場已安放先人骨灰，政府將不會大力執法，甚至有機會在稍後立法規管私營骨灰龕場時放生現有的違規龕場。另一方面，政府當局亦表示若違規龕場明顯長期佔用官地，或者已經無法申請改變規劃用途經營骨灰龕場，當局將以較大力度執法，本人對此回應亦相當質疑。本人認為：

1. 政府當局過去就違規龕場的執法明顯不力，無論是執法和檢控行動都相當有限，予人缺乏處理問題誠意的感覺；

2. 屯門極樂寺的個案明顯突顯政府執法不力的情況，該寺於2010年已遭發現佔用官地，但有關官地至今仍未遭政府收回，極樂寺方面亦在此真空期間出售多個龕位賺取利潤；政府口口聲聲針對佔用官地情況大力執法的說法，明顯不攻自破；

3. 政府當局必須再次公開強調取締違規龕場的決心，表明不會全數放生現存的違規龕場，亦應加強對消費者的宣傳，勸喻市民不應購買懷疑違規龕場的龕位；

4. 政府當局必須盡快展開立法審議的工作；在立法程序未完成前，政府當局必須積極加強執法，取締現存的違規龕場。
