陳家洛議員就2014年11月21日財務委員會主席的裁決的信件

張主席：

有關財務委員會主席的裁決

財務委員會今天繼續審議環境局「一焚三堆」撥款申請，  閣下於今天第二節會議後段突然宣佈終止議員就議題發問，不再容許議員在下次會議發問。本人對  閣下的裁決極度不滿，並表示強烈抗議。

本人要求  閣下向委員作出書面解釋，並解答下列問題：
1.      閣下裁決的理據為何；
2.      閣下作出裁決時，是否已能客觀無誤地證實本人以往多次提問，及提問內容不斷重複；若沒有，  閣下制止本人繼續提問的理據為何；
3.      閣下要求欲按會議程序第37A條提出議案的議員，應於2014年11月24日(一)下午五時或之前提交  閣下和秘書處，理據為何；
4.      閣下有沒有就上述問題(第3項)的決定，事前徵詢法律顧問的意見；會否抵觸第37A條指「委員可在有關該議程項目的待決議題付諸表決前，無須經預告而動議一項議案」的規定?

本人重申難以接受  閣下是次裁決，並認為  閣下嚴重破壞了財務委員會的議事規則，削弱立法會監察政府施政的權力。本人亦質疑  閣下所作裁決，疑有暗助特區政府通過撥款之嫌。

本人要求  閣下就裁決和上述問題，於2014年11月26日(三)或之前作出回覆。
