雍澄軒政府走漏眼 郭榮鏗要求各方跟進

證監會向外公布，認為有跡象指雍澄軒酒店房間的購買要約是在邀請公眾參與《證券及期貨條例》所界定的集體投資計劃或取得當中的權益，早前已開始調查事件，並表示可能會展開法律行動。今日（5月13日）證監會與長實達成協議，長實取消雍澄軒酒店房間的銷售項目，並須向雍澄軒買家退款及繳費利息。

公民黨立法會議員郭榮鏗早於今年3月4日致函證監會及立法會財經事務委員會，指出雍澄軒項目可能違反《證券及期貨條例》（香港法例第571章）有關集體投資計劃的條文，要求證監會及財經事務委員會跟進。郭榮鏗與證監會的來往信件隨此新聞稿附上。

郭榮鏗認為，政府當局早前在回應立法會有關雍澄軒項目的問題時，掉以輕心，沒有全面地檢視該項目可能出現的法律漏洞，令發展商有機會將項目推出市場，嚴重影響買家的利益。郭榮鏗呼籲，雍澄軒買家在收到長實取消交易的建議時，應盡快諮詢律師的意見，以保障自己的權益。另外，郭榮鏗留意到，長實將會以港幣10 000元來付還任何合理律師費及其他費用。然而，雍澄軒買家在購買雍澄軒的單位時，所付出的律師費、釐印費及其他費用，可能超過10 000元，證監會及長實應視乎每位買家的實際付出的費用去作出賠償。此外，據悉有不少雍澄軒買家在繳付訂金之後取消交易，被長實沒收訂金。郭榮鏗認為，證監會及長實理應顧及此類買家的情況，將沒收的訂金退還。

郭榮鏗亦會再次要求立法會財經事務委員會跟進此事件。
