公民黨就《取消使用強制性公積金制度下僱主的強制性供款「對沖」遣散費及長期服務金》意見書
世 界 銀 行 於 2005 年 所 提 出 之 退 休 保 障 有 五 大 支 柱 1， 以 確 保 退 休 後 的 長 者，能 夠 應 付 日 常 的 基 本 生 活 開 支、有 尊 嚴 地 生 活。套 用 於 香 港 的 情 況 ， 強 積 金 屬 於 第 二 大 支 柱 ， 即 是 由 私 營 機 構 管 理 的 強 制 性 供 款 計 劃 ， 旨 在 保 障 長 者 在 退 休 之 前 ， 已 經 有 一 筆 存 款 以 作 日 後 生 活 之 用 。 可 惜 ， 在 《 強 制 性 公 積 金 計 劃 條 例 》（ Cap. 485 Mandatory Provident Fund Schemes Ordinance， 下 稱 「 強 積 金 」） 容 許 僱 主 可 提 取 於 累 算 權 益 中 的 僱 主 供 款 部 份（ 即 對 沖 機 制 ），抵 銷 僱 員 按 第 57 章 《 僱 傭 條 例 》(Cap.57 Employment Ordinance)可 享 有 的 遣 散 費 或 長 期 服務金 2。公 民 黨 必 須 指 出，「 遺 散 費 」、「 長 期 服 務 金 」和「 強 積 金 」 是 三 個 南 轅 北 轍 概 念 ， 政 府 根 本 以 對 沖 作 為 手 段 將 三 種 不 同 的 勞 工 保 障 ， 巧 立 名 目 地 混 為 一 談 。 公 民 黨 認 為 現 行 的 制 度 嚴 重 削 弱 強 積 金 的 功 能，未 能 為 打 工 仔 的 退 休 生 活 提 供 足 夠 保 障。
因 此，公 民 黨 強 烈 要 求 政 府 立 即 落 實 取 消 強 積 金 「 對 沖 安 排 」（ Offsetting of Long Service Payment and Severance Payment），保 證 僱 員 應 有 的 退 休 保 障， 撥 亂 反 正 。
